Hosterella, LLC provides web hosting services to clients globally and acknowledges its duty to safeguard each client while delivering optimal services. All clients of Hosterella, LLC are governed by the subsequent terms of service:
Indemnification Policy
Upon utilizing Hosterella, LLC services and facilities, you accept the inherent risks. Hosterella, LLC explicitly disclaims all warranties of merchantability and fitness for specific purposes. Under no circumstances shall Hosterella, LLC be liable for any losses, data loss, or commercial damages, including but not limited to special, incidental, consequential, or other damages.
Customers affirm that they shall safeguard, indemnify, preserve, and exempt Hosterella, LLC from all claims, liabilities, losses, costs, and demands, including reasonable attorney's fees, asserted against Hosterella, LLC, its agents, customers, officers, and employees, arising from services provided, performed, agreed to be performed, or products sold by customers, their agents, employees, or assigns. Customers agree to protect, indemnify, and hold Hosterella, LLC harmless against liabilities arising from injuries to individuals or property caused by products sold or distributed in connection with Hosterella, LLC's server.
Hosterella, LLC retains the prerogative to intervene in sites hosted on its servers in the best interests of its clients. In cases of material provided by customers that infringe on the proprietary rights of third parties or violate copyright regulations, Hosterella, LLC will exclusively judge policy violations.
Billing
Currently, billing is conducted on a monthly, quarterly, semi-annually, or annually basis, contingent upon the plan. If unsatisfied within the first 30 days, a full refund will be provided (please note that certain special offers may vary; domain name registration fees are nonrefundable).
Accepted forms of payment include Visa, Master Card, American Express, and Discover Card. Web hosting plan accounts can be established without immediate payment. Clients are encouraged to utilize credit cards for seamless payment processing. No binding contract periods exist, but contracts will automatically renew unless otherwise notified.
Late Payments
All accounts are billed in alignment with their activation dates. Failure to renew services within 5 days of deactivation will lead to suspension. If services remain unpaid 30 days after deactivation, account termination will occur. An email reminder will be issued 5 days prior to deactivation.
Acceptable Use Policy
All services offered by Hosterella, LLC may only be employed for lawful purposes. Transmitting, storing, or presenting information, data, or materials in violation of any United States Federal, State, or City law is strictly prohibited. This encompasses copyrighted, threatening, obscene, or trade-secret-protected materials. Subscribers agree to indemnify and exonerate Hosterella, LLC and its employees from claims resulting from service usage causing harm to subscribers or other parties. Our acceptable use policy is rigorously enforced. Content or users in violation will be suspended from our network upon discovery, accompanied by notification detailing the action taken. Pornography is banned on all Hosterella, LLC servers, encompassing sites featuring explicit or hardcore imagery or advertising.
Limitation of Liability
Hosterella, LLC shall not be held liable for claimed damages, including consequential damages, arising from server unavailability or downtime. Additionally, Hosterella, LLC shall not be responsible for claimed damages, including consequential damages, resulting from website corruption or deletion from Hosterella, LLC servers. Damages shall be confined to immediate service termination.
Disclaimer
Hosterella, LLC cannot be held accountable for system downtime, crashes, or data loss. Nor can it be held accountable for any predicted profit estimates that clients could have obtained if their site was operational. Some Hosterella, LLC services are resold; certain equipment, routing, software, and programming are not directly owned or authored by Hosterella, LLC. Furthermore, Hosterella, LLC is not liable for client account usage. Failure to adhere to terms will result in automatic account deactivation. Hosterella, LLC reserves the right to remove accounts without prior notice for reasons deemed appropriate. Moreover, Hosterella, LLC maintains the right to modify any or all of the above Policies, Guidelines, and Disclaimer without prior notification.
